Consumer Rights Re Faulty Goods

Most people will have pondered on their consumer rights re faulty goods. 

This is probably a case of been there, done that.

Have you not received the good ordered?  Have you received garments that don't fit? 

Or have you received a ghastly gift that you would like to exchange?

Some retailers will take an item back and refund your money whatever your reason or alternatively you could have a fight on your hands.

Irrespective of the Christmas period, it pays to know your consumer rights re faulty goods.

Here we try to answer your questions:

If I change my mind about the purchase of a specific item, am I entitled to a refund?


Some retailers may have an exchange policy or issue a credit note to the value of the item you have chosen.  All retailers whether on the High Street or Internet have a duty to provide goods that are as described, are of a satisfactory quality and meet any specific purpose that you agreed with the seller.

Do not worry if you cannot produce a receipt.  Your Credit Card Statement (or Paypal) or a bank statement are sufficient evidence.

What are my rights if I shop online?

Goods bought online have a seven day cooling off period which begins the day the product arrives by post.  You have this right because you have not yet seen the item.  Delivery is your first chance to physically inspect what you have ordered so that you may check your consumer rights re faulty goods.

Therefore, unless the good are perishable or you have made personal specifications, or if you have removed all the specialized packaging, this means you have the right to cancel your order or change your mind.

You will be responsible for the cost of returning the goods, although some manufacturers are now including a 'free returns' service.  The seller must refund within 30 days. 

However, if you live in the country the expense of returning the goods is likely to be far less than the cost of petrol for your car or fares to a large shopping centre.

On such items as new bank accounts, energy tariffs and insurance products that are taken out online the cooling off period is extended to 14 days.

Does the 2 year warranty scheme under EU rules give me further benefits?

Yes and No.  This warranty does not mean you will be necessarily be better off.  Every country in the EU must ensure that a retailer can be held liable for all 'non-conformities' that occur within two years of purchase.

The UK Sale of Goods Act exceeds the EU directive as it meets or exceeds most of the EU directive requirements.

Does my Credit Card give me additional cover?

Yes, but only if the amount of the purchase exceeds £100 and is under £30,000.

Shoppers are protected under Section 75 of the Consumer Credit Act which means the credit card company is jointly liable with the shop if something you buy is faulty or fails to be delivered.  Here your consumer rights re faulty goods come into action.

Using your credit card to pay for a small part of the bill gives you protection which is worth bearing in mind if you don't want to put the whole bill on to your card.  However, bear in mind that an item must cost over £100 to qualify.

If the price tag is wrong does the shop keeper have to honour it?

Unfortunately the answer is 'No' - you have not struck gold!  You have no legal right to purchase for the stated price (if it is incorrect).

This also applies to on-line purchases.  If the mistake is noticed before you have been contacted by the seller there is no legally binding contract.  However, if the sale has been accepted you can insist the retailer sells you the goods at the advertised price.
